These are the Terms and Conditions of KidsWish Limited (ABN 34 649 591 239) Fundraising Raffle game conducted with Insight Holdings Consolidated Pty Ltd.

All funds received from this Raffle are directed to supporting KidsWish’s work with children living with disability or illness and their families. KidsWish is committed to fulfilling the lives of children with disabilities or illness and their families through supportive programs, special events and community projects, with a goal of building an inclusive community that can be enjoyed by all.

These are the Raffle conditions with the Raffle details above that apply to the game, your purchase of entries and as a member of the KidsWish Supporters Club.

In these conditions the Raffle purchaser, contact or entry holder as the case may be, is referred to as “you” and KidsWish and Insight are referred to as “us,” “we” or “our,” as the context requires.

All images are for promotional purposes only. Recommended Retail Prices for prizes are correct at the time of printing.

This appeal is conducted according to the Community Gaming Act 2018 NSW (and for Qld and Darwin/NT), the Charitable Fundraising Act 1991 NSW, Gaming Regulation Act 2005 Vic. and the Lotteries Act 1964 ACT. The KidsWish state Raffle permits and authorisations are set out in the key particulars above.

These Raffle conditions which amend or provide for rules outside the mandated rules are subject to change and correction. Please check these conditions from time to time. Significant changes to particulars or the addition of a bonus game will be identified on the Raffle web pages. A person who purchases entries into a Raffle Draw is deemed to have accepted and agreed to the Terms and Conditions.

Entries may be offered to KidsWish supporters via new web marketing channels managed by Insight Holdings Consolidated including www.mycharityraffle.com.au

You can enter the KidsWish Raffle by making a paid purchase or by payment of a pledge to pay for entries. Tickets in the KidsWish Raffle are sold to residents of NSW, Queensland, Darwin/NT, ACT, Tasmania, and Victoria by telephone or on this website kidswish.charityraffle.com.au, raffleresults.com.au or mycharityraffle.com.au

Your purchase of entries in the Raffle will give you entries in a specific KidsWish Raffle. There is also a single draw for a Book Buyers prize draw open to all entry buyers by purchasing 40 tickets or above in a one-time purchase or by subscribing to become a KidsWish Supporter Club Member and purchasing an accumulation of more than 40 tickets during the Raffle. The KidsWish Supporters Club Members also participate in draws each month during the current Raffle.

Entries are mailed or emailed to you. Entries are validated for the draw after payment is received. Entry tickets may also be available at public venues sold by approved vendors.

We take care to sell to adults who understand the purchase and can provide payment. Where a purchase is made by a young person, by someone inclined to irresponsible gaming or by a vulnerable person we will happily refund the entry purchase sum if that person has not played in a game. We are unable to make refunds after a draw in the absence of exceptional circumstances.

The KidsWish Raffle dates and times are notified in the table above. Unless otherwise specified, all times listed are AEST or AEDT.

Prize values are the recommended retail value as provided by the supplier and are correct at the time of printing. All prize values are in Australian dollars. Car colour is dependent on availability. *Entrants residing in Victoria must receive Gift Cards in lieu of cash prizes.

Entries are sold in bundles. If less than $30 is received entries are $5 each. Payments in sums that are greater than the agreed price will be rounded down to the next bundle, and if entries cannot be allocated with the balance, the excess will be accepted as a donation. To participate in the draws, we must receive payment from you before sales are closed.

Entrants must be 18 years of age and if successful in the draw, be able to personally receive the won prize in Australia. Our website may bar entry to persons overseas or in Australian states where sales are not permitted.

You may enter the Raffle more than once. Individual entry numbers may be denominated in integers larger than the maximum number of entries. Our management is not permitted to enter this Raffle.

Entries can be paid for with a payment card, cheque, direct debit, or digital payment wallet where available. When you pay with a debit or credit payment card, after registration with Westpac merchant processing, we may accept payment for subsequent purchases by resubmitting the registered reference number. You may decline to use that payment method. Payments falling due on a weekend or public holiday may be submitted the day prior and declined payments are retried within five days. To be eligible for a Raffle Draw, you must make payment before the draw. Direct debit payment instructions must be received one week before the draw date to ensure payment can be completed. If your paid entry cannot be entered in a draw you will be entered in the next available Raffle. KidsWish accepts no responsibility for late payment or payment not received for any reason. You may purchase entries on more than one occasion, and you may be offered bonus or incentive entries.

KidsWish Supporters Club members accept our invitation to join and receive entries in all raffles paid for automatically by making ongoing regular payments to KidsWish. As a KidsWish Supporters Club member you are allocated entries at the entry bundle rates from the total amount received during the Raffle campaign period before each major Raffle is drawn.

By joining the KidsWish Supporters Club you agree to make an initial payment and pay the chosen sum each month or on another recurring basis for payment toward each consecutive KidsWish Raffle. By agreeing to support KidsWish in this way, you authorise our service providers to automatically debit your payment card, nominated bank account or available digital payment wallet e.g. Apple Pay, on the nominated basis. You may make payment for entries in advance for up to one year’s raffles, up to a maximum of $600 per Raffle. You may cancel or amend your support level for your KidsWish Supporters Club membership at any time prior to the next payment.

As one of our KidsWish Supporters Club monthly recurring supporters we may contact you regarding future raffles. At the time of joining, we may ask you to automatically increase your support by up to $5 each month which will start on the first payment date after the annual anniversary of joining the KidsWish Supporters Club.

Your kind support can always be put to good use in KidsWish’s community work. To make that possible, we will notify you if we intend to provide additional entries paid for with an increase in your KidsWish Supporters Club support. If you do not wish to participate in that notified increase, please let us know before or after that change occurs. We will not increase your support within 6 months of joining or any other increase.

The raffle draws will take place at the draw location on the dates notified in the particulars above. In the draw for the prize winners, the major prize will be drawn first, and the other prizes drawn in descending order of prize value. A winner and all entries can win again in each further prize draw for which the entrant is eligible. Results of any draw or being unable to deliver the prize will be published as soon as possible, including on the first business day after the draw at www.kidswish.charityraffle.com.au, www.mycharityraffle.com.au. Winners are notified by phone on the day of the draw, and by email and mail and other reasonable means of making contact.

Except as to Victorian resident prize winners, any unclaimed prizes will be retained for 42 days while the first drawn winner is notified and asked to accept the prize. The notified prize winners must take delivery of the prize within 21 days of acceptance or be deemed to have rejected the prize. If that original prize winner cannot be located or rejects the prize, a replacement prize winner will be drawn from the original pool of valid entries within 14 days of notification on the websites. The replacement prize winner will be notified immediately after the further draw and given 7 calendar days in which respond to the notifications, failing which the replacement prize winner process will be repeated immediately by advertisement of a further redraw. Insight uses a standard set of enquiries to locate a winner who does not respond to the initial notice. The redraw will take place at the draw location. For Victorian resident entry purchasers the law of that state will be followed.

During any KidsWish Raffle fundraising campaign, Insight may offer you additional entries as part of a KidsWish entry purchase on specific conditions, for example, Trade Promotion lottery rules, to promote a KidsWish Raffle alone or with other charity fundraising games. You may be offered entries as an incentive to purchase, or entries may be allocated to you if you are already part of the same group of entrants. For example, $80 buyers may be allocated a free entry and those who previously made that purchase will be allocated entries. We will post the particulars of any bonus game as an addendum to these conditions together with a link to the bonus games’ full terms of entry. We may not directly notify you of the allocation of bonus entries. You can make a donation to KidsWish Ltd instead or in addition to your purchase. Donations are tax deductible for payments over $2 as a consequence of KidsWish holding deductible gift recipient status. A receipt will be issued for donations greater than $20.

There is an agreement with Insight Holdings Consolidated Pty Ltd (ACN 111 803 475) to promote or conduct this Raffle for reward. KidsWish bears no costs of conducting the Raffle. Fundraising services are provided by Insight Holdings Consolidated Pty Ltd of 5.02 / 241 Commonwealth St Surry Hills NSW 2010 Phone 1300 365 896 email c.service@insightcfs.com.au website www.insightfundraising.com.au which receives not more than 60% of the gross proceeds from which it meets all the prize, call centre, fulfilment and other approved costs.

To protect us, the operators of the Raffle from any cause which may imperil the success of the Raffle for us, we reserve the right in our absolute discretion to cancel or postpone any draw or series of draws, to recommence them and to change the Raffle game including by refunding payments in undrawn games, changing the Raffle rules, altering the prizes or changing the Raffle Draw schedule.

We may in our absolute discretion change or cancel the current or future draws including recommence them on new conditions in the event of the interference of an outside agent or event in any manner that adversely impacts or hinders the sales processes, the revenue objectives or any other part of the conduct of the Raffle, including but not limited to vandalism, power failures, tempests, pandemic, natural disasters, acts of God, civil unrest, atomic war, invasion, or strike. Any change under this clause will be notified on our Raffle website.

Nothing in this clause shall limit or alter your rights to consumer guarantees under the Australian Consumer Law.

KidsWish Limited and Insight Holdings Consolidated Pty Ltd collect your personal information at kidswish.charityraffle.com.au, in person, and over the phone to contact you to seek your support for Raffle participation and to administer your participation in draws for prizes. Funds raised from this Raffle are used to support children living with disability or illness and their families by KidsWish Ltd. Data we receive is kept securely in an encrypted form in secured, backed-up servers. For more information, please see Insight Holdings Consolidated Privacy Policy and other policies at www.insightfundraising.com.au/privacy-policy/ Banks, mail house, and other suppliers receive your information in order to provide services. If you do not provide contact information, we are unable to include you in the draw or provide our services.

Supporter personal information is not sent overseas for our work but that may occur in the future under supervised conditions. If that change occurs, this policy will be updated.
